POSITION SUMMARY:

The Alliance for Children’s Rights is seeking a dedicated Education Program Attorney to provide special education and early intervention advocacy for children. The attorney will assist foster children and education rights holders to secure early intervention and special education services through regional centers and school districts. The Education Program Attorney position is a wonderful opportunity for a well-qualified candidate to secure the benefits and services that these children need to succeed in school and in life.

We also help transition-age youth overcome barriers to their stability and success, and we work statewide to improve child welfare practices and policies in order to remove the many obstacles that our clients face. ESSENTIAL DUTIES AND RESPONSIBILITIES:


  • Represent clients in regional centers and school district meetings including IFSPs/IEPs, informal dispute resolution, mediations, and limited due process administrative hearings.

  • Train and supervise pro bono attorneys, interns, and law clerks.

  • Develop and update special education and early intervention materials for clients and the community; conduct community outreach and trainings.

  • Coordinate services with social workers, children’s attorneys, and the juvenile court to ensure appropriate special education and/or early intervention services for youth in foster care, who may range in age from birth through 21.

  • Represent the Alliance at education-related policy meetings; identify trends and advocate to implement policies to improve special education and/or early intervention services.

  • Perform additional administrative duties, including client record keeping.

QUALIFICATIONS:


  • California bar admission (or anticipated admission)

  • Experience in regional center or school district special education advocacy, and/or administrative due process/litigation highly preferable.

  • Experience with children in foster care, Dependency Court and/or child welfare system.

  • Excellent written and oral communication skills.

  • Strong interpersonal skills - ability to communicate effectively with clients, attorneys, child welfare agencies, the judiciary, and the public.

  • Excellent organizational skills.

  • Bilingual Spanish language skills preferable.

The Associate Attorney will work directly within our Employment Law department and work closely with our Workers’ Compensation department, Personal Injury department, and other departments within the Firm.  The Associate Attorney will represent clients on matters pertaining to violations of Federal, State, and Local employment agencies. In addition, the Associate Attorney will also provide in-house counsel to Firm Management on a variety of issues, as needed. 


 


The primary duties include, but are not limited to: 



  • Oversee and manage caseload from inception to closure; 

  • Provide availability/”open door” policy for paralegals/ staff to present questions on matters for managing attorney review and final approval; 

  • Conduct initial consultations of prospective clients; 

  • Conduct first in-person appointments to determine the viability of claim/s and identity of the employer, collect case information and relevant documents, and effectuate retention; 

  • Manage case deadlines, including ensuring timely action in all cases assigned; 

  • Work with managing attorney as the case develops and to determine the best litigation strategy;  

  • Review and assess matters to ascertain the likelihood of recovery, case value, pre-litigation or litigation strategy, etc.; 

  • Answer client questions and guide him or her through the employment dispute process; 

  • Maintain communication with the client(s) and staff through the course of the claim and litigation. Maintain communication with the client(s) and staff through the course of the claim. This includes meeting with clients (in-person, over the phone and/or in court) to initiate contact, answer questions, and discuss case updates, settlement, and additional claims; etc.;   

  • Gather evidence; 

  • Take depositions of the Applicant, employers/supervisors, and other parties;

  • Propound/Respond to discovery, 

  • Perform legal research; 

  • Negotiate settlements on behalf of the claimant; 

  • Remain current with developments in the law; 

  • Draft Right to Sue Letters, pleadings, findings of fact, complaints, demands, motions, briefs, opinions, and other legal documents;  

  • Represent the interests of the claimant at hearings, trials, depositions, oral arguments, mediations, arbitrations, and other proceedings; 

  • Litigate cases in court; and 

  • Other duties as assigned by Management. 


 


Qualifications: 



  • Juris Doctorate degree and current good standing with CA State bar is required; 

  • Minimum 1-3 years’ experience working in a law firm Employment department; 

  • Must possess strong interpersonal and social skills;  

  • Demonstrates and takes initiative and has compassion for those requiring our services; 

  • Excellent written and verbal communication skills; 

  • Must have good familiarity with Employment Law and Workers’ Compensation terminology; and 

  • Bilingual, fluent in English/Spanish preferred.
